Apple urges Supreme Court that Samsung review petition is 'legally unexceptional'

About a month ago, the South Korea based technology giant Samsung filed a request in the highest court of US, asking to review the decision that make them as accused, back in 2012 in the patent infringement lawsuits. In a judgement back then, Samsung has been asked to pay Apple whopping $548 million in damages.

Now, Apple responded to that request, urging Supreme Court not to review calling Samsung's petition as 'legally unexceptional.' Apple's attorney argues in the filing saying, "Samsung's effort to make this case seem certworthy depends on a made-up narrative in which Samsung, not Apple, the innovator, despite the overwhelming evidence that Samsung copied iPhone's innovative design."

Apple believes that the original rulings in the iPhone maker's favor "broke no legal ground." Instead, the company argues, that they "simply applied the statute and well-settled law to the extraordinary record of infringement and copying" committed by Samsung.

However, Samsung feels that "it is important to appeal this case to the US Supreme Court on behalf of all US companies, big and small, that could be affected if this legal precedent stands." And amicus curiae (friends of court) and major industry players, IP law professors echoes the same sentiments.

It will be an uphill task for Apple's lawyers to defend their filing, given the amount of support Samsung garners from tech community. Stay tune, while we keep you updated with the more details as it emerges.
